After millions of illegal aliens were released into the country through new parole programs created by the Biden administration, at least 1 million people received Temporary Protected Status (TPS), which protects them from deportation outside of these parole programs. This also includes citizens of countries of foreign concern regarding terrorism.

As of September 30, 2024, approximately 1,095,115 foreigners were granted TPS. new report From the Congressional Research Service.

They are citizens of Afghanistan, Burma, Cameroon, El Salvador, Ethiopia, Haiti, Honduras, Lebanon, Nepal, Nicaragua, Somalia, South Sudan, Sudan, Syria, Ukraine, Venezuela and Yemen.

As violence against Israel escalated, the Biden administration also granted TPS to Palestinian and Lebanese nationals.

TPS was granted under President Joe Biden. continued to extend National emergency orders that address national security threats related to terrorism, threats from Afghanistan, Sudan, Syria and other countries, and foreign threats related to: weapons of mass destructionand the Islamic threat that expanded under his administration, Center Square. reported.

The Secretary of Homeland Security approved TPS, arguing that the law provides discretion. TPS can last 6 to 18 months, but is often extended. For example, in Liberia, publicly reported unknown numbers have been granted TPS since 2017, according to the report.

Whenever a TPS is approved, DHS issues a notice explaining its terms. For example, on October 11, DHS Extended TPS status For illegal aliens from El Salvador, Honduras, Nepal, Nicaragua, and Sudan until March 9, 2025.

People enrolled through the program can continue to submit extensions. The re-registration process for Salvadorans is currently ongoing until March 9, 2025.

People who receive TPS are granted Deferred Departure (DED) status, which is temporary, discretionary, administrative stay of removal. The CRS explains that it “emanates from the President’s constitutional authority to conduct foreign relations and has no legal basis.”

According to the CRS report, of those granted TPS and DED, 834,000 have entered the United States illegally or are illegally present in the United States overstayed on their visas. This status protects them from deportation and grants them work authorization, which critics argue takes away Americans’ jobs and drains taxpayer resources related to the welfare services they receive.

A number of TPS aliens residing in the United States include:

  • 260,790 Haitians approved TPS extension until February 3, 2026.
  • 256,625 Venezuelans approved TPS extension until April 2, 2025.
  • As of March 3, 2026, 248,775 Venezuelans have been reassigned to TPS.
  • 52,585 Hondurans whose TPS termination was canceled or extended;
  • 63,425 Ukrainians approved TPS extension until April 19, 2025.

Additionally, an unknown number of Palestinians and Lebanese have been granted TPS and DED until August 2025 and January 2026, respectively, according to the CRS report.

Initially, TPS was granted to 74,500 Afghans until November 20, 2023. However, according to multiple reports and concerns raised by the U.S. House of Representatives Homeland Security Committee, no process is in place to remove TPS after it expires.

According to the CRS report, there are currently only 9,630 Afghans granted TPS by May 2025.

President-elect Donald Trump has pledged to repeal TPS, which Congress enacted under the 1990 Immigration Act signed by former President George H. W. Bush.

In 2017 and 2018, Trump’s DHS ended TPS designations for citizens of Central American countries. In response, two class action lawsuits were filed. In September 2020, the Ninth Circuit Court of Appeals overturned the lower court’s injunction and allowed the termination of the TPS designation. Biden reversed Trump’s policy and expanded TPS authorization.
