Top Judiciary Democrats Call on Alito to Recuse Himself from Trump Hush Money. SCOTUS APPEAL

Following reports that President Trump spoke with Justice Samuel Alito before appealing to the court to delay his sentencing on a felony conviction, House Judiciary Committee Top Democrat Jamie Raskin said in a statement to PoliticusUSA:

Yesterday, we learned that President-elect Trump spoke with Justice Alito just hours before asking the Supreme Court to halt sentencing in New York. Justice Alito ignored this astonishing one-way private phone call and violation of judicial ethics, insisting that this perfectly timed conversation constituted an actual recommendation of the former clerk for an administrative position. Judge Alito’s decision to speak personally with President Trump, especially in conjunction with his past partisan ideological activities in support of Trump, makes it clear that he fundamentally misunderstands the basic requirements. He either has judicial ethics or, more likely, believes that he transcends judicial ethics as a whole.

In a democracy, Americans expect their cases to be heard by fair judges. This concept of fairness predates the court’s own code of conduct and is also based on early versions of federal recusal laws.

In a situation where the president-elect has an active interest in a matter currently pending before the court, it is clear that a mere private phone call is sufficient to trigger a situation in which ‘the justice’s impartiality could reasonably be questioned.’ .

Every federal judge and judge knows to avoid situations like this. But Justice Alito did not.

Impartial justice under the Constitution requires Justice Alito to adhere to the highest ethical standards and avoid even the appearance of impropriety. In light of the continued displays of political bias and subsequent abuse of the public trust, Justice Alito ruled that, under the Constitution, federal law, and the Supreme Court’s own code of conduct, in Donald J. Trump v. New York, et al., the matter was actually before the full Court. If referred.

Representative Raskin is right. It doesn’t matter whether Alito actually helps Trump in this case. Just talking to President Trump before the appeal is heard could seem inappropriate.

The current Supreme Court majority acts as if it is above the law, so it is standard operating procedure for the justices of this court to meet with Trump before he delays sentencing.

This type of behavior has caused Americans to lose trust in the Supreme Court, and public trust in the court has reached an all-time low.

The Supreme Court majority has become a powerful partisan political advocacy group.

SCOTUS is in a national crisis with a conservative majority, and Democrats cannot regain power fast enough to take action against this corrupt court.
